Thirty-three teachers nationwide have had their appointments canceled, according to the Teachers Service Commission (TSC).
TSC Chief Executive Officer Nancy Macharia stated in a February 5 Gazette notice that the action was taken in compliance with the authority provided by Section 30(2) of the Teachers Service Commission Act.
“In exercise of powers conferred by section 30(1)(e) of the Teachers Service Commission Act, Chapter 212 of the Laws of Kenya, the Commission wishes to notify the public that the persons whose names are specified in the Schedule herein below have been removed from the Register of Teachers pursuant to the provisions of section 30(2) of the Teachers Service Commission Act,” the notice in the Gazette stated.
According to the Act, anyone who is deregistered will instantly lose their status as a teacher and be prohibited from teaching in any capacity, whether in a public or private school.
Following the publication of a comprehensive list with the names of the instructors whose services had been terminated, the Gazette notice also disclosed that the teachers had been deregistered from the TSC with effect from January 7, 2025.
TSC clarified in the same Gazette announcement that the teachers had been deregistered after the disciplinary procedure, suggesting that the named persons may have committed professional violations.
A teacher may be struck from the register for a number of reasons, chief among them being misbehavior, as stated in Section 30 of the TSC Act.
The TSC has the authority to deregister a tutor for a number of reasons, including false registration, sexual offense conviction, criminal conviction, and physical or mental disease that prevents the teacher from carrying out their obligations.
Since then, school administrators have been warned not to hire anyone who isn’t registered with the TSC in any capacity because doing so might result in a punishment of at least KSh100,000 or two years in jail.
“Further to the provisions of the TSC Act, Regulation 18(1)(c) and (d) of the Code of Regulations for Teachers, as read together with Section 45 of the TSC Act, states that any person who is not a registered teacher under the Act and engages in teaching or assists in teaching at any school is in violation of the law,” the amended notice stated.
Only a few months after another 33 teachers were expelled from the TSC in August 2024, this is the most recent round of deregistrations.
In accordance with disciplinary action, the TSC deregistered 65 teachers months prior, however they did not identify the specific violations.
