Because he hasn’t provided enough evidence to support his release, the High Court has refused to grant former Kiambu Governor Ferdinand Waititu bail pending his appeal.
Waititu had requested bail, stating that one of the reasons for his release was health issues.
But in its decision on Monday, the court said that prisons have adequate medical facilities and that inmates are sent to a reference hospital if they have major health problems.
The petitioner must persuade the court that the appeal is debatable and has a chance of success, the court stated, adding that the right to bail is not granted automatically.
His claim that the appeal would take a long time to process was also rejected by the court, which stated that since the main appeal had already been filed, the court diary would guarantee that the appeal will be considered and decided in less than two months.
Rather, the court has ordered that the primary appeal be heard in order of precedence.
Waititu had appealed the lower court’s decision last week, which had sentenced him to 12 years in prison or a fine of Ksh. 52.5 million for a graft case of Ksh. 588 million.
